Jane Hils Shea is chair of the Privacy and Information Security Law Practice Group at Frost Brown Todd LLC. She practices primarily in the areas of commercial law, privacy law, bank regulatory law, and electronic funds transfer laws and regulations. Ms. Shea has spent sixteen years serving as counsel to several Cincinnati area banks and also served twelve years as an Adjunct Professor of Law at University of Cincinnati College of Law.
In this presentation, we explore developments and trends in the area of data privacy and information security law. The growing use of the Internet and technology in B2B and B2C commerce has created increasing tension in the legal struggle between individual privacy rights and securing digital environments.
In the absence of a comprehensive federal law, many states have been filling the gap by enacting their own variations of protections and remedies. Ms. Shea provides an overview of these current trends in state law, such as security breach notification statutes, identity theft criminal and civil remedies, and security freeze legislation, as well as recent federal and state regulatory enforcement actions.
