Current and Emerging Issues in Data Privacy Protection Law

Jane Hils Shea is chair of the Privacy and Information Security Law Practice Group at Frost Brown Todd LLC. She practices primarily in the areas of commercial law, privacy law, bank regulatory law, and electronic funds transfer laws and regulations. Ms. Shea has spent sixteen years serving as counsel to several Cincinnati area banks and also served twelve years as an Adjunct Professor of Law at University of Cincinnati College of Law.

In this presentation, we explore developments and trends in the area of data privacy and information security law. The growing use of the Internet and technology in B2B and B2C commerce has created increasing tension in the legal struggle between individual privacy rights and securing digital environments.

In the absence of a comprehensive federal law, many states have been filling the gap by enacting their own variations of protections and remedies. Ms. Shea provides an overview of these current trends in state law, such as security breach notification statutes, identity theft criminal and civil remedies, and security freeze legislation, as well as recent federal and state regulatory enforcement actions.

Joining Ms. Shea is Joey Valentine, a Senior System Engineer with Ecora Software. Joey shares how Ecora's Auditor Professional 4.5 can provide comprehensive reporting of how the infrastructure protecting your data is configured, particularly, how to create policies and rules validating system configurations around critical data continue to be sustained, and how to identify changes in your system configuration that could make you vulnerable to an internal or external data breach.

What we'll cover:

  • Current Trends in State Data Privacy Law
  • Recent Federal and State Regulatory Enforcement Actions
  • Understanding how secure the infrastructure surrounding your data is
  • How you can identify unanticipated system configuration changes
  • Automating configuration reporting to validate data-related compliance regulations
